The rules for using Evergreen Notes, written as clearly as we can.

1. About these terms

These Terms and Conditions (“Terms”) apply to your use of evergreennotes.com (the “Website”) and every game, page and service on it. In these Terms, “we”, “us” and “our” mean Evergreen Notes, and “you” means anyone using the Website.

By using the Website, playing a game or creating an account, you agree to these Terms, our Privacy Policy and our Cookies Policy. If you don't agree, please don't use the Website.

2. Who can use the Website

  • You must be 18 years of age or older.
  • You must live in the United Kingdom.
  • You must not be using the Website where doing so would break any law that applies to you.

We ask you to confirm your age when you first visit and again when you create an account. If we believe someone under 18 is using the Website, we will close the account straight away.

3. Free-to-play and virtual coins

Evergreen Notes is free to play. There is no real-money gambling, nothing to buy and no prizes of money or real-world value.
  • Games are played with virtual coins (“Coins”). Coins are given free: as welcome coins when you join, as a daily bonus, or inside the games themselves.
  • Coins have no monetary value. They cannot be bought, sold, traded, transferred, gifted, exchanged or withdrawn, and they are not your property.
  • We may change how many Coins are given, the daily bonus amount, levels and XP rules at any time.
  • Results in our games are for entertainment only. Doing well in a free game does not mean you would do well at real-money gambling.

4. Your account

You can play every game without an account. If you create one:

  • Give accurate details and keep your email address up to date.
  • Use a strong password that you don't use anywhere else, and keep it secret. We will never ask you for it.
  • You may hold only one account. Accounts are personal and can't be shared, sold or transferred.
  • You are responsible for activity on your account. Tell us straight away if you think someone else has accessed it.
  • If you sign up with Google, Google's own terms also apply to your Google account.

Your account is stored securely on our server. Five incorrect password attempts in a row will lock your account for 15 minutes.

5. Our games

All games on the Website are created and hosted by us and load inside our pages. We aim to keep them available and working well, but we don't guarantee that every game will always be available, uninterrupted or error-free. We may add, change or remove games at any time.

If a game malfunctions, any affected results, Coins or XP may be corrected or removed.

6. Fair use

You agree not to:

  • use bots, scripts, cheats or any automated means to play or to collect Coins, XP or bonuses;
  • create multiple accounts, or use someone else's account;
  • attempt to access, probe or interfere with our servers, account files, logs or any part of the Website that isn't meant for you;
  • copy, reverse-engineer or re-host our games, artwork or code;
  • upload or send anything unlawful, abusive, misleading or harmful through our forms;
  • use the Website if you are under 18 or outside the United Kingdom.

7. Intellectual property

The Website, its games, names, logos, artwork, music, text and code belong to Evergreen Notes or our licensors and are protected by copyright and other laws. You may use them only to play on the Website for your own personal, non-commercial enjoyment.

8. Other services

Some features use other services, such as Google Sign-In. Links to other websites (for example, support organisations) are provided for information only; we are not responsible for their content.

9. Closing or suspending accounts

You can delete your account at any time from My account, or ask us through our contact form or by email at [email protected]. You can also ask us to pause or restrict your account using the Player Care form on our Support page.

We may suspend or close an account, and remove its Coins, XP and levels, if we reasonably believe these Terms have been broken, the account holder is under 18 or outside the UK, or to protect players or the Website. Because Coins have no value, no compensation is due when an account is closed.

10. Our responsibility to you

The Website is provided free of charge and “as available”. As far as the law allows, we are not liable for any loss of Coins, XP, levels or progress, or for any indirect loss. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law of England and Wales. Your statutory rights as a consumer are not affected.

11. Changes to these terms

We may update these Terms from time to time. The date at the top of this page shows the latest version. If we make important changes we will show a notice on the Website. Continuing to use the Website after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the law of England and Wales. You and we both agree that the courts of England and Wales have non-exclusive jurisdiction, so if you live in Scotland or Northern Ireland you may also bring proceedings there.
